December 9, 2011 –Apple received two strikes in a row in two separate cases involving patent infringement all in one day, the first from leading gadget manufacturer Samsung, the second from Motorola. Bloomberg reports that Samsung’s victory involved Apple’s request to extend the ban of Samsung’s Galaxy 10.1 tablets in Australia. These tablets happen to be Apple’s iPad’s biggest competition, and though the technology titan was able to hold a ban over its competition since mid-October, the three-judge High Court panel were not convinced this time around and lifted the ban, allowing Samsung to sell its tablets in Australian stores just before Christmas. Samsung Australia’s mobile chief told The Sydney Morning Herald that because of this highly-publicised court case, online marketing for the Galaxy Tab 10.1 has shot through the roof and has become a household name.
Apple’s second blow came from losing its battle with Motorola, this time with the latter claiming the former of infringement. This case was ruled in favour of Motorola over in Germany, banning Apple’s iPhones and 3G-enabled iPad in Germany and marking a substantial loss for Apple.
According to web design, website development and technology publication TechCrunch though the news of Apple’s many infringement cases have haunted online newsrooms to the point of monotony, analysts say now it’s different. LIG Investment and Securities analyst Choi Do Yeon told Bloomberg, “While the win in Australia won’t give a big boost to Samsung’s revenue, it should be seen as symbolic.” According to Yeon, Samsung has suffered a lot through its many previous losses, but now it’s recovering. James Song, analyst at Daewoo Securities Co. told Bloomberg that Apple and Samsung have been fighting “under different circumstances in so many different countries,” and given the reliance of the two companies on each other plus Samsung starting to win in some cases, Song believes a settlement may soon be achieved.
For Motorola, the recent win means a possible injunction on all old iPhones and 3G-enabled iPads against Apple Sales International.
It certainly seems as though the once invincible company that Steve Jobs helped create and carry to the top is now losing its supremacy beginning with these case losses, and many are starting to believe it could be losing even more in 2012. According to an article on CNET, Apple may be facing some tough competition from rival companies Google, Amazon, and Microsoft, along with partners Intel, Samsung, HP, and Lenovo in terms of product innovation and sales. CNET points out that already Samsung’s phones are outselling Apple’s iPhones, and with Android becoming more and more appealing to consumers with more user-friendly apps available, it seems only inevitable that Apple would lose in the area of mobile phones.
CNET adds that in terms of notebook computers and tablets, though Apple is currently in the lead competitors Windows and Kindle Fire are not far behind, and with the rate the Kindle Fire is going with its low price, it is sure to outsell the iPad next year.
Despite these grim predictions though, the future is still quite uncertain, and though Apple’s primary innovator Steve Jobs is no longer around to move the company to the next level, it is certain that the company will continue to push boundaries, albeit not necessarily as the leader of the pack.
